These terms and conditions apply to the site, app, and all products and services offered by Cudents. It governs how Cudents collects, uses, maintains and discloses information collected from its users through the app or site.

User Rights

Users have the option to not register on the Website/Application if they do not want to share the mandatory personally identifiable information required to do so. Users may modify or delete their profile details from their account settings on the Website/Application. Users are encouraged to keep their information up-to-date.

User Obligations

By using the Services, User agrees to abide by the below obligations:

• User must provide complete and accurate information while registering on the Website/Application and while contacting the company. Further, User must not impersonate as any other person.
• Maintain the confidentiality of the account details and be responsible for any use of the Services through the account.
• User must not use the Services, Website or Application to perform any illegal activities nor solicit the performance of any illegal or any activity which leads to violation of third party's rights.
• User must not attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages, or make derivative version.
• User must not upload any material which contains software viruses, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource used to provide the Services.
• It is the responsibility of the user to keep the phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the Cudents app may not work properly or at all.
• User must not advertise or solicit any products or services on the Website/Application without taking prior permission from Cudents.
• User must not probe, scan or test the vulnerability of the Website/Application
• User must not disrupt or breach the security or authentication measures or circumvent the navigational structure, with respect to the Website/Application or the network
• User must not use any manual or automated software, devices or other processes to "crawl" or "spider" any part of the Website/Application
• User must not interfere with the proper working of, or places an unreasonable burden on, the Company's infrastructure.
• You are solely responsible to the Company and to any third party for any breach of Your obligations under the Terms of Use and for the consequences (including any loss or damage which the Company or its affiliates or its Users may suffer for any such breach).
• User is not allowed to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
• Company disclaims any and all special, incidental, indirect, consequential or punitive damages, losses costs towards any User or third party arising from the provision of Services or use of the Website/Application by others.
• User must ensure a proper internet connection. There are certain things that Cudents will not take responsibility for. Certain functions of the app or site will require to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Cudents cannot take responsibility for the app or site not working at full functionality if you do not have access to proper internet data.
• User must not trace any information pertaining to another User or exploit any such information, including storing and collecting the same.
• User must not use, misuse or misappropriate the trademark 'Cudents' or any design of the Website/Application, which are owned/used by the Company for any unauthorized purpose.
• We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
• This Agreement shall be governed by and construed in accordance with the laws of India without regard to the conflict of law’s provisions thereof. All claims, differences and disputes arising under or in connection with or in relation hereto the Application or Services, the Terms or any transactions entered into on or through the Application or Services shall be subject to the exclusive jurisdiction of the courts in India and You hereby accede to and accept the jurisdiction of such courts.

Rights of the company

The following rights should be acknowledged by the users

• We have the right to suspend or terminate the account of any User to access all or part of the Services, at our discretion, including for violation by the User of these Terms and Conditions and/or Privacy Policy.
• The Service and all components thereof including the Website/Application and all logos, trademarks, brand names, service marks, domain names, including designs, and graphics created by and developed by the Company on the Website/Application and other distinctive brand features of the Website/Application are exclusively owned by the Company and all intellectual property rights vested therein belong to the Company.
• Any Company Content belongs to the Company or its licensors and assignors. No rights therein transfer to the Users except for the purpose of legitimate use of the Service in accordance with these Terms of Use.
• Company shall process the personal data of the Users submitted in accordance with the Privacy Policy.
• We may put in place enhanced security and technical measures from time to time to prevent and tackle violation of copyrights of Users or third parties, as suitable.
• Occasionally there may be information on our site/application or in the Service that contains typographical errors, inaccuracies or omissions. We reserve the right to correct any errors, inaccuracies or omissions at any time without prior notice.
• We undertake no obligation to update, amend or clarify information in the Service or on any related website. No specified update or refresh date applied in the Service or on any related website/application, should be taken to indicate that all information in the Service or on any related website/application has been modified or updated.
• Certain content, products and services available via our Service may include materials from third-parties.
• Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

Payments

We have integrated with an external payment gateway to accept payments. We don’t ask for or store any card details such as card number, validity, or CVV on our site. All these details are handled by the external system. We will like to state that Cudents has no control over the terms and conditions of the payment provider. We advise the users to go through the terms and conditions of the payment provider before sharing the sensitive information.

Points redemption

The points earned by playing the quizzes and games can be redeemed in exchange for various gifts listed on our site. Please note that we fulfill the redemption requests directly through third party vendors and we do not own or keep stock of any inventory. The pictures of the gifts are for representation only and the actual gift may vary from the picture. In case a gift is not available with the vendor, we will replace it with another related gift of similar value. Kindly note that we do not sell any of these products and these can only be redeemed through points. Further note that we don't promote or advertise the brands of these products on our site. In case there is any issue with the gift, please raise a request by sending a mail to info@cudents.com with the redemption id. We will try our best to resolve the issue based on the terms and conditions of respective third party vendor.

Cudents has the rights to update these terms and conditions at any time. Every time these are updated, the “last updated date” will be updated at the top of the page. We encourage our users to regularly check this page for any changes to terms and conditions.
